Firearms trial put off to April

9 March 2010

Four men charged with possession of an unlicensed firearm have had their trial adjourned until 12 April.

The defendants are Keith Bryan Orrett, 41; Brian Emmanuel Borden, 24; Bjorn Connery Ebanks, 25; and Keith Rohan Montaque, 21.

Grand Court proceedings began on 16 February with the selection of a jury that week (Caymanian Compass, 22 February).

On Thursday, 4 March, Justice Charles Quin told jurors, “We have reached the stage where we have had a number of legal arguments and they have been resolved.”

However, he continued, there were now problems concerning expert witnesses from overseas who could not be in Cayman for the next couple of weeks. As a result the trial has been adjourned until Monday, 12 April.

The judge told these jurors they were excused attendance until then. Although they have not yet heard any evidence, he reminded them not to discuss the case with anyone and not let anyone approach them about it.

Details of the first count on the indictment are that Orrett, Ebanks and Montaque were in possession of a P-Beretta 12-gauge shotgun at a West Bay address 4-7 April 2008 without a licence for it.

The second count charges Orrett, Borden and Montaque with possession of a Remington model 870 12-gauge shotgun during the same period and at the same address, also without a licence for it.

The case for the prosecution is being conducted by Crown Counsels Tricia Hutchinson and Candia James.
